Complex IP litigation effort successfully closed-out by Ijdelea Mihăilescu

The dispute resolution team of Ijdelea Mihailescu led by Managing Associate Ancuța Pop has successfully represented Velikov I Co, one of the largest seed producers in Central and Eastern Europe, in a complex litigation concerning the violation of IP rights regarding a community trademark and community design, widely known and permanently used by the client on the European market. The dispute involved, inter alia, an international component, related to confirmation of the validity of the client’s IP rights before the European Union Intellectual Property Office.

The court decision Ancuța and her team obtained granted all the claims as they were raised, acknowledged trademark infringement, awarded significant damages for the prejudice incurred as a result of counterfeit actions and prohibited the defendant to use the community trademark and design in any manner. The dispute resolution team was seconded by Associate Adrian Manolache of the firm’s administrative law department.

“This is an excellent result of a long and complex legal effort which entailed the interplay between a series of administrative, civil and criminal proceedings” stated Partner Oana Ijdelea.

The newly ruled upon dispute is one of the several mandates the client entrusted us with in connection with the protection of the IP rights arising out of the company’s community trademarks and designs portfolio, whose outcome will be influenced by the recently obtained decision.

Ijdelea Mihăilescu are an exceptionally intelligent team of lawyers and their force when it comes to defending Velikov i Co’ interests is amazing. We are glad to have them as our lawyers” declared Severin Velikov, the company CEO.
